PREAMBLE & LEGAL NOTICE

CultureBlitz™ ("we," "us," "our," "the Company") operates a global e-commerce storefront at www.cultureblitz.biz, serving customers across multiple legal jurisdictions worldwide. This policy constitutes the complete legal framework governing the relationship between CultureBlitz™ and any person ("you," "the customer," "the consumer," "the user") who accesses, browses, or transacts on this storefront.

This policy is designed to meet or exceed the mandatory consumer protection, data privacy, commercial, and indemnity law requirements of the:

    European Union & EEA (including post-Brexit United Kingdom)
    United States of America (federal and state level)
    Japan
    Commonwealth nations (including Australia, Canada, New Zealand, and others)

Platform Notice: This storefront is powered by Shopify Inc. In the context of data processing, Shopify operates as both an independent data controller (for its own platform services) and a data processor acting on CultureBlitz™'s instructions (for store-specific customer data). CultureBlitz™ remains the primary data controller for all customer data collected through this storefront and retains full authority, accountability, and legal responsibility for its lawful handling. See Part C for the full data controller framework.


PART A — TERMS OF SALE
A1. Formation of Contract

No binding contract exists until CultureBlitz™ issues a formal order confirmation email. Acknowledgement of an order, automated responses, or payment processing alone do not constitute acceptance. CultureBlitz™ reserves the right to refuse, cancel, or limit any order at its sole discretion — including for suspected fraud, pricing errors, prohibited items, export restrictions, or stock unavailability — with a full refund issued promptly where payment has already been taken. CultureBlitz™ shall bear no liability for losses arising from a refused or cancelled order beyond the refund of amounts paid.
A2. Product Descriptions & Pricing

    All product descriptions, images, and specifications are provided in good faith but are subject to change without notice.
    Prices are displayed in USD and cover product costs only. They exclude import duties, customs fees, VAT/GST, and destination-country taxes, which are the buyer's sole responsibility.
    In the event of a manifest pricing error, CultureBlitz™ reserves the right to cancel the order and issue a full refund, without obligation to honour the erroneous price.
    CultureBlitz™ makes no warranty that product descriptions are error-free, complete, or current, to the fullest extent permitted by law.

A3. Sale of Goods — No Refund Policy & Mandatory Statutory Overrides

General Commercial Position: All sales are final. Goods once sold are non-refundable. This is CultureBlitz™'s default commercial policy.


A4. Defective, Damaged, or Misdescribed Goods 

Regardless of jurisdiction, customers must notify CultureBlitz™ within 48 hours of delivery with photographic or video evidence to Sales@cultureblitz.biz if goods arrive damaged, defective, or materially different from their description. Failure to notify within this period does not affect statutory rights but may limit our ability to investigate carrier liability. We will offer repair, replacement, or refund as required by applicable law.
A5. Order Cancellations

Orders may be cancelled within 24 hours of placement by contacting Sales@cultureblitz.biz. After this window, fulfilment may have commenced and cancellation cannot be guaranteed. EU, UK, Japanese, and Commonwealth consumers retain their full statutory withdrawal and cooling-off rights regardless of this clause.

Delivery timelines are estimates only and are not contractually guaranteed. CultureBlitz™ is not liable for delays caused by carriers, customs authorities, natural disasters, pandemics, strikes, or other force majeure events beyond our reasonable control.
B2. Import Duties, Taxes & Customs

All international orders may be subject to import duties, VAT/GST, and customs fees levied by the destination country. These charges are the buyer's sole responsibility and are not included in our prices. CultureBlitz™ has no control over and cannot predict customs charges.

    EU: For orders under €150, VAT may be collected at checkout via the EU Import One-Stop Shop (IOSS) scheme where applicable.
    UK: For orders under £135, UK VAT is collected at point of sale per HMRC rules.
    US: Import duties may apply depending on product category (federal de minimis threshold: $800).
    Japan: Consumption tax (10%) and customs duties may apply.
    Australia: GST (10%) applies under the Low Value Imported Goods (LVIG) regime for orders under AUD $1,000.
    Canada: GST/HST applies depending on province; de minimis threshold CAD $20 for duties.

B3. Risk of Loss & Title

Risk of loss and title passes to the buyer upon handover to the carrier, except where consumer law provides otherwise. Notably, under EU Consumer Rights Directive 2011/83/EU Art. 20, risk passes to the consumer only upon physical delivery. Under Australian Consumer Law, risk allocation clauses that disadvantage consumers may be unenforceable.
B4. Force Majeure

CultureBlitz™ shall not be liable for any failure or delay in performance of its obligations caused by circumstances beyond its reasonable control, including but not limited to: acts of God, war, terrorism, pandemic, government action, carrier failure, cyberattack, or infrastructure failure. In such events, CultureBlitz™ will notify affected customers and endeavour to fulfil orders as soon as reasonably practicable.
PART C — PRIVACY POLICY & DATA CONTROLLER FRAMEWORK
C1. Data Controller Structure & Accountability

Shopify Inc. (a Delaware corporation) operates in a dual capacity:

    As an independent data controller for data Shopify collects through its own platform services — including Shopify Payments, Shop Pay, Shopify's fraud analysis engine, Shopify's own analytics, and Shopify's marketing infrastructure. For this data, Shopify's Privacy Policy governs exclusively: shopify.com/legal/privacy. CultureBlitz™ bears no responsibility for Shopify's independent data controller activities.
    As a data processor acting strictly on CultureBlitz™'s documented instructions for store-specific customer data (order records, customer profiles, contact information stored in the Shopify admin). In this capacity, Shopify is bound by a Data Processing Agreement (DPA) with CultureBlitz™ and applicable law.

Joint Processing: Where both CultureBlitz™ and Shopify jointly determine the purposes and means of processing (e.g., checkout analytics, storefront behaviour tracking), both parties may be considered joint controllers under GDPR Art. 26. The arrangement between CultureBlitz™ and Shopify governs the allocation of responsibilities between them. Customers may direct privacy requests to either party; CultureBlitz™ will coordinate with Shopify as necessary.

Identical rights to EU GDPR apply. Complaints: Information Commissioner's Office (ICO) — ico.org.uk. CultureBlitz™ processes UK personal data in compliance with the UK International Data Transfer Agreement (IDTA) framework for cross-border transfers.
🇺🇸 United States — CCPA/CPRA & State Privacy Laws

California residents have the right to:

    Know what personal information is collected, used, shared, or sold.
    Delete personal information (with statutory exceptions).
    Correct inaccurate personal information.
    Opt out of sale or sharing of personal information. (We do not sell or share personal data for cross-context behavioural advertising without consent.)
    Limit use of sensitive personal information.
    Non-discrimination for exercising privacy rights.

Submit requests: Email Sales@cultureblitz.biz — Subject: "CCPA Privacy Request" — Response within 45 days (extendable by 45 days with notice). Two requests per 12-month period honoured free of charge.

Non-essential cookies are placed only with prior explicit consent (EU/UK ePrivacy Directive; UK PECR). Consent may be withdrawn at any time via our cookie preference centre. Third-party tools (e.g., Google Analytics, Meta Pixel) are subject to their own privacy policies. We maintain a full cookie register available on request.

We do not knowingly collect data from minors below the applicable threshold. Confirmed minor data will be deleted immediately upon discovery. Parents/guardians may contact Sales@cultureblitz.biz to request deletion.
PART D — INDEMNITY
D1. Customer Indemnity Obligation

To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless CultureBlitz™, its officers, directors, employees, agents, licensors, suppliers, and platform partners (including Shopify Inc.) (collectively, "the Indemnified Parties") from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable legal fees and court costs) arising out of or relating to:

    (a) Your breach of any provision of this policy or any applicable law or regulation;
    (b) Your use or misuse of the CultureBlitz™ storefront, products, or services;
    (c) Any content, information, or materials you submit, post, or transmit through the storefront;
    (d) Your violation of any third-party rights, including intellectual property rights, privacy rights, or consumer protection rights;
    (e) Any fraudulent, negligent, or wilful misconduct on your part in connection with a transaction or interaction with CultureBlitz™;
    (f) Any chargeback, payment dispute, or fraudulent payment initiated by you or on your behalf without prior good-faith engagement with CultureBlitz™;
    (g) Your provision of false, inaccurate, or misleading information at any stage of the purchase process.

D2. CultureBlitz™ Indemnity Obligations

CultureBlitz™ agrees to indemnify, defend, and hold harmless customers from and against claims arising directly from:

    (a) CultureBlitz™'s gross negligence in the fulfilment of orders.
    
   
D3. Shopify Platform Indemnity Carve-Out

CultureBlitz™'s indemnity obligations do not extend to losses arising from Shopify's independent platform operations, including but not limited to: Shopify Payments processing failures, Shop Pay disputes, Shopify's own data breaches, or Shopify platform outages. For such matters, customers should refer to Shopify's Terms of Service at shopify.com/legal/terms and Shopify's own indemnity provisions. CultureBlitz™ will cooperate in good faith with any investigation involving Shopify's platform where customer interests are affected.
D4. Third-Party Indemnity

CultureBlitz™ is not liable for and does not indemnify against losses arising from:

    (a) Third-party carrier failures, delays, or damage in transit beyond our reasonable control;
    (b) Customs authority actions, import refusals, or seizures;
    (c) Third-party payment processor failures (including but not limited to Shopify Payments, Stripe, PayPal);
    (d) Third-party app or service failures integrated into the storefront;
    (e) Force majeure events as defined in Part B4.

D5. Indemnity Procedure

Any party seeking indemnification ("Indemnitee") must:

    Promptly notify the indemnifying party ("Indemnitor") in writing of any claim for which indemnification is sought — delay in notification that materially prejudices the Indemnitor's ability to defend may reduce or void the indemnity obligation.
    Grant the Indemnitor reasonable control over the defence and settlement of the claim, provided that no settlement imposing liability or obligations on the Indemnitee shall be made without the Indemnitee's prior written consent.
    Provide reasonable cooperation, information, and assistance to the Indemnitor in the defence of the claim at the Indemnitor's expense.

PART E — LIMITATION OF LIABILITY
E1. General Limitation

To the maximum extent permitted by applicable law, CultureBlitz™'s total aggregate liability to any customer — whether in contract, tort (including negligence), breach of statutory duty, or otherwise — shall not exceed the total value of the goods purchased in the relevant transaction.
E2. Exclusion of Consequential Loss

To the maximum extent permitted by applicable law, CultureBlitz™ shall not be liable for:

    Loss of profit, revenue, or anticipated savings;
    Loss of business or contracts;
    Loss of data or goodwill;
    Indirect, incidental, special, punitive, or consequential damages;

arising out of or in connection with the use of this storefront or the purchase of goods, even if advised of the possibility of such damages.


PART F — DISPUTE RESOLUTION & GOVERNING LAW

Before initiating any formal legal proceedings, customers must:

    Contact Sales@cultureblitz.biz with full details of the complaint.
    Allow CultureBlitz™ 14 business days to investigate and respond.
    Engage in good-faith negotiation for a further 14 business days if the initial response does not resolve the matter.

This pre-action protocol does not affect any statutory rights or limitation periods.
F1. Alternative Dispute Resolution

CultureBlitz™ supports resolution of disputes through ADR where available and appropriate. EU consumers may use the EU ODR Platform. UK consumers may use approved ADR schemes. Other consumers may use applicable national consumer dispute resolution services.
F2. Limitation of Actions

Any claim against CultureBlitz™ must be brought within the limitation period prescribed by the law of the consumer's jurisdiction. CultureBlitz™ will not invoke a shorter contractual limitation period where doing so would deprive a consumer of a statutory right.
PART G — INTELLECTUAL PROPERTY
G1. Ownership

All content on www.cultureblitz.biz — including but not limited to text, images, graphics, logos, product designs, and software — is the property of CultureBlitz™ or its licensors and is protected by applicable intellectual property laws worldwide.
G2. Permitted Use

Customers are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the storefront for personal, non-commercial purchasing purposes only.
G3. Prohibited Use

You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any content from this storefront without CultureBlitz™'s prior written consent. Unauthorised use may give rise to claims for damages and/or criminal liability.
PART H — GENERAL PROVISIONS
H1. Entire Agreement

This policy, together with any order confirmation and product-specific terms, constitutes the entire agreement between CultureBlitz™ and the customer, superseding all prior representations, warranties, or agreements, whether oral or written.
H2. Amendments

Material changes will be communicated via email or prominent website notice at least 14 days before taking effect. Continued use of the store after the effective date constitutes acceptance of the revised policy. For EU/UK consumers, material changes to terms that are less favourable require explicit re-consent where required by law.
H3. Waiver

Failure by CultureBlitz™ to enforce any provision of this policy shall not constitute a waiver of that provision or any other provision.
H4. Assignment

CultureBlitz™ may assign its rights and obligations under this policy to a successor entity in the event of a merger, acquisition, or sale of assets, provided that the successor entity assumes all obligations under this policy. Customers may not assign their rights without CultureBlitz™'s prior written consent.
H5. Language

This policy is written in English. In the event of conflict between a translated version and the English version, the English version prevails, except where local law requires otherwise (e.g., Quebec, France, Japan).
H6. Shopify Platform Disclaimer

CultureBlitz™ uses Shopify as its e-commerce platform provider. Shopify's independent data controller activities, platform terms, and privacy practices are governed by Shopify's own legal documents at shopify.com/legal. CultureBlitz™ is not responsible for Shopify's independent data processing activities or platform-level decisions.
